  • Flying debris can cause severe injuries - maintain 6-meter (20 feet) safety distance

1. Safety Agreement & Operator Responsibility

BINDING AGREEMENT: By purchasing, operating, or allowing others to operate the Grator Lowrider, you agree to these terms in their entirety. If you do not accept these terms, do not use the product and return it immediately.

1.1 Operator Responsibility (Indemnification)

You accept full responsibility for operating the Grator Lowrider safely, following the user manual completely, and using good judgment at all times. You are liable for any harm caused by your operation, including:

  • Actions by others operating with your permission
  • Injuries or damage due to your negligence
  • Failure to maintain proper safety perimeter
  • Operation by untrained or unauthorized persons
  • Failure to wear or provide required safety equipment

1.2 Transfer of Ownership

If you sell, gift, or otherwise transfer the Grator to another party, you must:

  1. Ensure the new owner accepts these terms at grator.com/terms
  2. Provide complete user manual and safety documentation
  3. Inform them of all safety requirements
  4. Document the transfer with written acknowledgment

If you fail to do so, you remain liable for any incidents involving the machine.

1.3 Prohibited Users

You will NOT permit the following persons to operate the Grator:

  • Minors under 18 years of age
  • Persons without proper safety training
  • Individuals under influence of alcohol or drugs
  • Anyone with impaired judgment or reaction time
  • Persons who have not read the complete user manual

1.4 Operator Training Requirements

Before first operation, all users must:

  • Read complete user manual (minimum 30 minutes review time)
  • Review all safety warnings and operational procedures
  • Understand emergency stop procedures
  • Acknowledge understanding of all safety requirements in writing

Commercial and professional users should maintain training records documenting operator competency. Failure to ensure proper training may void warranty protections and increase liability exposure in case of incidents.

2. Essential Safety Requirements

2.1 Pre-Operation Safety Checklist

Before EVERY use, you MUST:

  • Verify all joystick controls are in neutral position
  • Ensure 6-meter (20 feet) clear safety perimeter
  • Check all thumb-screws are properly tightened
  • Verify battery is secure and properly connected
  • Inspect for damage or loose components
  • Ensure all operators and bystanders have face shields (ANSI Z87.1/EN 166)
  • Review terrain for hazards and slope angles

2.3 Battery Safety

Lithium-ion batteries require special handling:

  • Charge only in well-ventilated areas
  • Keep charger and battery several meters from flammables
  • Never expose to temperatures above 60°C (140°F)
  • Handle carefully to avoid dropping
  • Store in cool, dry location
  • Inspect regularly for damage or swelling
  • Dispose only through authorized recycling centers

2.3.1 Battery Regulatory Compliance

The batteries supplied with Grator products:

  • Comply with UN 38.3 transport testing standards
  • Meet all applicable EU Battery Regulation requirements
  • Must be recycled through authorized WEEE collection points
  • Must never be disposed in household waste (penalties apply)
  • Can be returned to Grator for free recycling - visit grator.com/contact for prepaid return label

2.4 Slope Operation Warnings

CRITICAL: While the Grator is engineered to handle slopes up to 70°, this is an engineering limit, NOT a safe operating recommendation. Operating above 40° drastically increases rollover risk.

  • Always travel straight up or down slopes - NEVER sideways
  • Assess terrain for obstacles (rocks, roots, vines)
  • Consider weather conditions (wet grass increases risk)
  • Practice in safe areas before attempting slopes
  • Have escape plan if machine begins to overturn

2.5 CE Marking and Conformity

This product bears the CE marking in accordance with applicable EU directives:

  • Machinery Directive 2006/42/EC
  • EMC Directive 2014/30/EU
  • Low Voltage Directive 2014/35/EU
  • Outdoor Noise Directive 2000/14/EC

The complete EC Declaration of Conformity is included in your user manual (final page) and confirms compliance with all essential health and safety requirements. Product serial numbers allow traceability to specific conformity assessments.

2.6 Operational Location Considerations

This machinery is designed for professional agricultural and landscaping use:

  • Check local regulations regarding noise restrictions in your area
  • Respect quiet hours in residential zones
  • Commercial insurance is recommended for professional use
  • Some municipalities may require permits for powered equipment operation
  • Ensure compliance with all local ordinances before operation

3. Purchase Terms & Conditions

3.1 Order Process

By placing an order, you confirm:

  • You are at least 18 years old
  • All information provided is accurate
  • You have authority to use the payment method
  • You understand this is professional equipment requiring skill
  • You will comply with all local regulations for operating machinery

3.2 Pricing and Payment

  • All prices are in EUR unless otherwise stated
  • Prices include Slovenian VAT (22%) for EU customers
  • B2B customers with valid EU VAT number: reverse charge applies
  • Payment methods: bank transfer, credit card
  • Full payment required before shipment

3.2.1 VAT Application by Country

  • Slovenian VAT (22%) applies to all EU sales unless:
    • Valid EU VAT number provided (reverse charge mechanism applies)
    • Distance selling thresholds exceeded (we monitor and comply with all EU thresholds)
  • Non-EU customers: prices shown exclude VAT
  • Buyer responsible for any import duties or local taxes in destination country

3.3 Delivery Terms

  • Standard delivery time: 30 days from order confirmation
  • Current backlog may extend delivery (check website for updates)
  • Delivery to address specified in order
  • Buyer responsible for customs/import duties outside EU
  • Risk transfers upon delivery (Incoterms DAP)

3.4 Inspection Upon Delivery

You MUST inspect the product immediately upon delivery:

  1. Check packaging for damage
  2. Document any damage with photos
  3. Note damage on delivery receipt
  4. Report damage within 48 hours
  5. Failure to report = acceptance of condition

3.4.1 Delivery Signature Requirements

Due to dangerous machinery classification:

  • Adult signature required (18+ years, ID may be verified)
  • Safety documentation must be acknowledged
  • Delivery may be refused if safety requirements cannot be confirmed
  • Photo documentation of delivery condition recommended

3.5 Export Controls and Sanctions

  • Buyer confirms compliance with all applicable export control laws
  • Products may contain technology subject to export restrictions
  • Re-export to third countries may require authorization
  • Prohibited from export to sanctioned countries or entities
  • Buyer indemnifies Grator for any sanctions violations

4. Warranty Terms

4.1 Warranty Coverage

Grator d.o.o. provides the following warranty:

  • Duration: 1 year from delivery date (EU minimum for consumers)
  • Coverage: Defects in materials and workmanship under normal use
  • Remedy: Repair or replacement at our discretion
  • Response time: Within 30 days of valid claim

4.2 Normal Use Definition

Normal use is defined as:

  • Maximum 4 hours per day
  • Maximum 28 hours per week
  • Maximum 784 hours per year (28-week season)

Usage exceeding these limits is considered professional/power-user operation and may affect warranty coverage.

4.3 Warranty Exclusions

The warranty does NOT cover:

  • Excessive use beyond normal operating conditions
  • Misuse, neglect, or failure to follow user manual
  • Damage from liquid exposure (rain, submersion, pressure washing)
  • Corrosion from improper cleaning or storage
  • Forceful connector misuse or cable damage
  • Impact damage (rolling, collision, blade hitting rocks)
  • Consumable parts (blades, screws, bolts, nuts)
  • Unauthorized modifications or repairs
  • Normal wear and tear
  • Damage from accidents or natural disasters
  • Improper charging or battery handling
  • Failure to install safety-critical firmware updates when provided

4.4 Warranty Claim Process

    • Serial number and purchase date
    • Detailed description of issue
    • Photos/videos of problem
    • Usage history estimate
  2. We may request return for inspection
  3. If warranty valid: repair/replace at no cost
  4. If warranty void: quote for paid repair
  5. Return shipping costs: our responsibility for valid claims

4.5 Spare Parts Availability

In accordance with EU regulations:

  • Spare parts guaranteed available for minimum 10 years from purchase
  • Functional spare parts: typically available within 15 working days
  • Wear parts: availability based on reasonable demand

4.6 Software and Firmware

  • Grator may provide firmware updates for safety and functionality improvements
  • Safety-critical updates will be provided free for minimum 2 years
  • Installation of safety updates is strongly recommended
  • Optional feature updates may be available
  • Reverse engineering or modification of software is strictly prohibited
  • Remote control operation requires acceptance of software license terms

5. Consumer Rights (EU)

5.1 Right of Withdrawal (14-Day Cooling Off)

As an EU consumer, you have the right to withdraw from purchase within 14 days without giving reason.

Withdrawal Conditions:

  • Notify us within 14 days of receiving product
  • Return product within 14 days of notification
  • Product must be in original condition
  • You bear return shipping costs (€150-300)

Testing Limits:

IMPORTANT: You are liable for diminished value from handling beyond necessary testing.

Testing is limited to:

  • Less than 1/4 battery cycle

Diminished Value Charges:

You will be charged €50/operational hour plus restoration costs if inspection reveals:

  • Grass residue/dirt buildup beyond minimal testing
  • Wheel wear indicating production use
  • Blade dulling from extended use
  • Scratches indicating commercial operation
  • Battery usage beyond testing limits

5.2 Statutory Guarantee Rights

Your statutory rights under EU law remain unaffected:

  • 2-year legal guarantee for consumers
  • Burden of proof on us for first year
  • Right to repair, replacement, price reduction, or refund
  • Protection against hidden defects

5.3 Business Purchases

For B2B purchases:

  • No withdrawal rights - all sales final
  • Commercial warranty terms apply
  • 6-month warranty unless extended
  • Immediate inspection and notification required

6. Liability & Indemnification

6.1 Limitation of Liability

To the maximum extent permitted by law:

  • Grator d.o.o.'s total liability limited to purchase price
  • No liability for indirect, consequential, or punitive damages
  • No liability for lost profits or business interruption
  • No liability for third-party claims

6.2 Exceptions

Limitations do NOT apply to:

  • Death or personal injury from our negligence
  • Fraud or fraudulent misrepresentation
  • Gross negligence or willful misconduct
  • Rights that cannot be excluded under EU law

6.3 Your Indemnification

You agree to indemnify and hold harmless Grator d.o.o., its directors, employees, and agents from:

  • Claims arising from your use/misuse of product
  • Injuries to third parties under your control
  • Property damage from your operation
  • Violations of local laws or regulations
  • Failure to maintain safety requirements
  • Allowing unauthorized persons to operate

6.4 Insurance Recommendation

STRONGLY RECOMMENDED: Obtain liability insurance covering machinery operation. Many homeowner policies exclude commercial equipment. Verify coverage before operating.

6.5 Product Recall Procedures

In the unlikely event of a safety-critical recall:

  • Immediate notification via email to registered customers
  • Safety instructions posted at grator.com/terms (in this section)
  • Free repair or replacement as determined appropriate
  • Reasonable related expenses covered where applicable
  • Your cooperation with recall instructions is required
  • Failure to respond to safety recalls may void warranty and liability protections

Purchase of a Grator product grants you a non-exclusive, non-transferable license to:

  • Use any embedded software as intended for product operation
  • Make backup copies of documentation for personal use

9.3 Restrictions

You may NOT:

  • Copy, reverse engineer, disassemble, or modify the product

  • Use our trademarks without prior written permission
  • Manufacture copies or derivative products
  • Resell products as new without authorized dealer agreement

10. Dispute Resolution

10.1 Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Republic of Slovenia, without regard to its conflict of law principles.

10.2 Jurisdiction

For Business (B2B) Customers:

  • Exclusive jurisdiction of the District Court of Maribor, Slovenia
  • All disputes must be brought in Slovenian courts

For Consumer (B2C) Customers:

  • You may choose courts in your country of residence (per EU Regulation 1215/2012)

11.1 Entire Agreement

These terms constitute the entire agreement between you and Grator d.o.o. regarding the purchase and use of Grator products, superseding all prior agreements, understandings, or representations.

11.2 Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

11.3 No Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative.

11.4 Force Majeure

Neither party shall be liable for delays or failures in performance resulting from causes beyond reasonable control, including:

  • Natural disasters (earthquakes, floods, storms)
  • War, terrorism, civil unrest, government actions
  • Pandemic, epidemic, or health emergencies
  • Labor disputes, strikes, lockouts
  • Material shortages or supply chain disruptions
  • Infrastructure failures (power, internet, transportation)

11.5 Assignment

You may not assign or transfer these terms or your rights without our prior written consent. We may assign our rights and obligations to successors or affiliates.

11.6 Amendments

We reserve the right to update these terms at any time. Material changes will be notified via email to the address associated with your account. Continued use after changes constitutes acceptance.

11.7 Language

These terms are drafted in English. Translations may be provided for convenience. In case of conflict between versions, the English version prevails.
